CONTEST AGREEMENT
This Contest Agreement ("Agreement") is entered into as of December 12, 2024 or the date you click “I Agree” to the terms of this Agreement, is being hosted by Fitnessista and you, the person who is agreeing to participate in the content.
Any person who participates (the “Participant”) in the Contest agrees to be bound by all of the Rules which are outlined below.
Parties. Fitnessista is a company operating out of the Arizona (“CC” “we”, “us”, and “our”) and you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Agreement (“you” and “your”).
- Eligibility: The Contest is open to anyone who agrees to be bound to the terms of this Agreement and fairly and properly participates in the Contest.
- Entry requirements: Participants must be 18 years or older.
3.1 Enter to Win: Enter your email and automatically participate in the contest.
3.2 Multiply your Chances: Elevate your odds of winning by sharing the Contest with your friends and colleagues. For every person who enters using your unique referral link, you'll earn 20 extra points!
3.3 Level Up with Social Media: Follow us on your favorite platforms (Facebook, Instagram, Twitter, etc.) and rack up additional points. The more platforms you connect with, the closer you'll be to seizing that golden opportunity.
3.4 Winner: From all the participants, the software that runs the program, UpViral, will choose one winner (the more points you have, the higher your chance of winning).

4.2: Dates and Selection of the Winner: December 24, 2024
4.3: The winner will receive a Prize once the contest ends. The timeline for the contest is December 12, 2024 to December 24th, 2024. Once we have verified the winner, they will receive an email with instructions to claim their prize.
4.4 The winner will be randomly selected by UpViral, the software that runs the contest, based on all the participants who properly participated in the contest.
4.5: If the winner does not respond within three business days from notifying the winner, the contestant with the next highest amount of points will be contacted and selected.
4.6 The Winner may be announced via the Company’s website and social media platforms during the month following the contest.
- Publicity Release: By accepting the Prize, the winner agrees to allow Fitnessista to use their name, likeness, and submitted content for promotional purposes
- No Guarantees. No participant or any other person who participates or attempts to participate in the contest is guaranteed to win anything. There will only be one winner for the contest.
- Limitation of Liability: Participants release Fitnessista and its affiliates, and their respective officers, directors, employees, contractors and agents from any liability, claims, damages, or losses arising out of their participation in the Contest or the acceptance, use, or misuse of the Prize. The company isn’t liable for the winner’s failure to receive notification of winning if he or she provided a wrong email address or incorrect phone number or if their email security settings caused your prize notification to go into the spam or junk folder
- Collection of Personal Information: Personal information collected from contest entrants will be used by Fitnessista for the purpose of administering this contest. Entrants are able to opt out with respect to receiving such marketing information online. Fitnessista will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in our Privacy Policy in the bottom of our website found at www.fitnessista.com.
- Terms and conditions: Fitnessista reserves the right, without prior notice and at any time but subject to any governmental or other regulatory approval which may be required, to terminate the contest, in whole or in part, or modify, suspend or extend the contest in any way, if it determines, in its sole discretion, that the contest is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the contest.
- Disqualification. We reserve the right to disqualify anyone who violates the terms of this Agreement. We reserve the right to seek damages to the fullest extent permitted by law in cases where a participant has caused deliberate damage or undermined the legal operation of the promotion.
- No Waiver: No waiver by any party hereto of any breach of any covenant, representation, warranty, proviso, condition or stipulation herein contained whether express or implied or negative or positive in form by any other party hereto shall have any effect or be binding upon any party hereto unless same shall be in writing and under the authority of such party, and any waiver whatsoever shall extend only to the particular breach so waived, and shall not limit or affect the right of any party with respect to any other or further breach.
- Standard Legal Things. Choice of Laws and Venue. This Agreement will be governed exclusively by the laws of Arizona. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the Province of British Columbia. Severability. If any provisions or terms of this Agreement are invalid or unenforceable, the other provisions and terms in the Agreement will remain in full force and effect. Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you. Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree” (or something similar), the effect of which will be the same as if we signed the Agreement by hand
