This Sweepstakes is sponsored and administered by TicketSmarter, Inc. (“TicketSmarter”), having its principal place of business at 7007 College Blvd, Suite 100, Overland Park, Kansas 66211.

SWEEPSTAKES PERIOD:

Entries to the Christian Lundgaard Autographed IndyCar Jersey Sweepstakes will be accepted online only beginning on March 31, 2023 at 12:00 p.m. Central Standard Time (“CST”). All online entries must be received by April 7, 2023 at 12:00 p.m. CST (the “Sweepstakes Period”).

HOW TO ENTER

ELIGIBILITY: This Sweepstakes is only open to legal residents of the United States who are of the age of majority or older in the applicable jurisdiction in which the Contestant resides, but not less than 18 years old. This Sweepstakes is intended for play in the 50 United States and the District of Columbia only and will be governed by U.S. law. Do not enter unless you are eligible and located in the United States during the Sweepstakes Period. ALL OTHERS ARE INELIGIBLE TO ENTER AND WILL BE DISQUALIFIED. Employees of TicketSmarter or Rahal Letterman Lanigan Racing, LLC, or any of their respective parent companies, affiliates, subsidiaries, advertising agencies, participating sponsor or any other company involved with the design, production, execution or distribution of the Sweepstakes and their immediate family members (spouse, parents, siblings, children, and their respective spouses) and household members of each such employee (whether or not related) are not eligible to participate in or win the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations, and is void where prohibited by law.  

AGREEMENT TO RULES: By participating, you, (the “Contestant” or “You”) agree to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of TicketSmarter as final and binding as it relates to the content of this Sweepstakes. Any illegal activity or activity contrary to these Rules is grounds for disqualification. Winning a prize is contingent upon being compliant with these Rules and fulfilling all other requirements set forth herein. By participating, You agree to be bound by the UpViral.com (“UpViral”) terms and conditions in using the UpViral platform, which can be reviewed at www.upviral.com. Any personally identifiable information provided by You during your participation in this Sweepstakes will be collected by TicketSmarter and may be used by TicketSmarter, UpViral (collectively its owner, Emarky B.V.), their affiliates, agents and marketers, for marketing purposes and for the proper administration and fulfillment of the Sweepstakes as described in these Rules.

You must complete the electronic lead generation form by providing all requested information and ensuring that the form submitted successfully.  Notwithstanding the foregoing, to be eligible for the Sweepstakes, You may not post comments or any content that in any way incites, advocates, or expresses hatred, ethnic slurs, bigotry, racism, or gratuitous violence, uses personal insults, pornography, vulgarity, profanity, obscenity, or other offensive language or content, depicts nudity or lewd content of any sort, promotes beverage alcohol along with unsafe activities that could lead to an unsafe situation, promotes excessive consumption of alcohol beverages, irresponsible consumption of alcohol beverages such as drunk driving, promotes any illegal drug use, misrepresents the source of anything in your posted content, including impersonation of another individual or entity. Retweets will not gain any entries to this Sweepstakes.

Your entries must comply with these Rules and fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Anyone found to have used multiple accounts to enter will be ineligible and/or disqualified. Entries that are incomplete or do not adhere to the Rules or specifications may be disqualified at the sole discretion of TicketSmarter. Entries generated by script, macro or other automated means are void, as are entries that are illegible, garbled, incomplete and/or that contain errors. TicketSmarter is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be disqualified. Potential winners may be required to show proof of identity. In the event of a dispute as to the identity of the rightful winner, TicketSmarter will gather proof of identity from the disputing parties and will solely be entitled to choose the winner. In the event You submit an entry containing an email address that is not your own, You warrant and represent that You have permission to use such email address and any violation of this warranty will explicitly disqualify You from the Sweepstakes.

There is no charge for entering as free Internet access is available at many public libraries. If You do not use free Internet access, normal time, toll, connection, and usage rates, if any, charged to You by your Internet service provider will apply and be paid by You. All entries become the property of TicketSmarter. No other entry method will be accepted. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with, Twitter, Facebook, or Instagram (collectively, “Social Media Platforms”), nor with Rahal Letterman Lanigan Racing, LLC, INDYCAR, LLC, or any other organization other than the Sponsor, TicketSmarter. Neither the Social Media Platforms, nor Rahal Letterman Lanigan and INDYCAR, LLC assume any responsibility for the conduct or administration of this Contest. You are providing your information to TicketSmarter and not to Twitter, Facebook, or Instagram. See Rule 4 below. ACCESSING APPLICATION: Entry requires using the UpViral application (“Sweepstakes Application”) https://upvir.al/138942/lp138942. The link to UpViral will be accessible through TicketSmarter’s Facebook and Twitter pages and will allow You to access the Sweepstakes Application. The information you provide will only be used to administer this Sweepstakes and, except as permitted in these Rules, in accordance with our privacy policy, located at https://www.ticketsmarter.com/privacy-policy#privacy.

DRAWING: One (1) winner will be selected in a random drawing to be held on or about April 7, 2023 at 12:00 p.m. CST from all eligible entries received. Your odds of winning depends on the number of eligible entries received. Proof of transmission is not proof of receipt of your entry. All decisions of TicketSmarter are final and binding with respect to all matters related to the Sweepstakes.

PRIZE: There will be one (1) potential winner in this Sweepstakes. The random drawing, as detailed in Rule 5 above, to select the winner will be supervised and administered by TicketSmarter. The winning entry in the Sweepstakes (the “Winner”) will receive as the Sweepstakes prize, one Christian Lundgaard Autographed IndyCar Jersey. This prize is the only prize available in this Sweepstakes. The approximate retail value of the prize is $175.00.  The specifics of the prize shall be solely determined by TicketSmarter. No transfer, substitution or cash redemption will be awarded in lieu of the stated prize except by TicketSmarter, who reserves the right to substitute the prize (or portion thereof), in its sole discretion, if the advertised prize becomes unavailable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No request for the cash equivalent, substitutions, or the assignment and/or transfer of the prize to others, by Winner is permitted. Acceptance of the Sweepstakes prize constitutes your permission for TicketSmarter to use Winner’s name, likeness, and entry for purposes of advertising, publicity, promotion, and trade without further compensation, unless prohibited by law. If you are selected as the Winner, your information may also be included in a publicly-available winner’s list.

WINNER NOTIFICATION: Winner will be notified through an email from TicketSmarter within two (2) days following selection of Winner. TicketSmarter, and its parent companies, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, shall have no liability for Winner’s failure to receive notices, including due to spam, junk e-mail or other security settings, or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within two (2) days from the time award notification was sent, and/or fails to timely return any required executed declarations or consents, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any winner later determined to be ineligible under these Rules may be required to return the awarded prize. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, IN TICKETSMARTER’S SOLE DISCRETION, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

RIGHTS GRANTED BY YOU: By entering this Sweepstakes, You understand and agree that TicketSmarter, and anyone acting on behalf of TicketSmarter, including, without limit, TicketSmarter’s parent companies, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent, You agree to execute further specific consents to such use if asked to do so. 

TERMS & CONDITIONS: TicketSmarter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond TicketSmarter’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, TicketSmarter may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by TicketSmarter. TicketSmarter reserves the right, in its sole discretion, to disqualify any individual who tampers, or attempts to tamper, with the entry process or the operation of the Sweepstakes or website or violates these Rules. TicketSmarter has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same computer in excess of that allowed by these Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, TicketSmarter reserves the right to seek damages to the fullest extent permitted by law. This Sweepstakes is subject to all applicable laws and regulations and is void where prohibited. TicketSmarter, and each of its respective parents, subsidiaries, affiliates, and agents, shall have no responsibility for any damage to your computer, web-enabled mobile device, smartphone or telephone system that is directly or indirectly caused by participating in the Sweepstakes,  or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, dropped or delayed computer transmissions or network connections that are human or technical in nature. TicketSmarter and each of its respective parents, subsidiaries, affiliates, and franchisees are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in your email account/social media account to receive messages. TicketSmarter and each of their respective parents, subsidiaries, affiliates and agents are not responsible, and may disqualify You, if your social media account, email address, telephone, or other contact information does not work or is changed without You giving prior written notice to TicketSmarter. TicketSmarter and each of its respective parents, subsidiaries, affiliates, and agents, are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to any website.  Any use of robotic, automatic, macro, programmed or third-party entry methods at any website will void all such entries by such methods, and disqualify You for using such methods.

INDEMNITY/LIMITATION OF LIABILITY: By entering this Sweepstakes, You, the entrant, agree to release and hold harmless TicketSmarter, Inc., Rahal Letterman Lanigan Racing, LLC, UpViral and its owner, Emarky B.V., the Social Media Platforms, INDYCAR, LLC, and each of their parent companies, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors (collectively, the “Released Parties”) from and against any and all claims or causes of action, including but not limited to personal injury, death, or damage to or loss of property, arising out of or relating to (i) your participation in this Sweepstakes and/or the receipt or use or misuse of any prizes granted herein; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (v) electronic, printing, typographical, or human error in the administration of the Sweepstakes, the announcement of the prize, or the processing of entries. By participating in this Sweepstakes, You waive all rights to claim punitive, incidental, and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter the Sweepstakes. TicketSmarter makes no warranties covering any of the prizes furnished as part of this Sweepstakes.

GOVERNING LAW AND JURISDICTION: This Sweepstakes shall be governed by and construed in accordance with the laws of the State of Kansas without regard to its choice of law principles. Any action arising from or relating to this Sweepstakes, these Rules, or the prizes, (i) must be brought individually, and without resort to any form of class action, in the District Court of Johnson County, Kansas (and its appellate courts) or in the U.S. District Court for the District of Kansas (and its appellate courts), and the parties hereby irrevocably consent to the exclusive jurisdiction of, and venue in, such courts, and hereby waive the right to object to such location on the basis of forum non conveniens, and (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, and in no event shall attorneys’ fees be awarded.

CLASS ACTION WAIVER. Each party hereto agrees that an arbitrator, judge, magistrate or other similar authority may not consolidate more than one person’s claim, and may not otherwise preside over any form of a representative or class proceeding, and that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You agree to waive any right to a jury trial or a class action arising from or relating to this Sweepstakes, these Rules, and/or the prizes.

Requests must be received no later than April 7, 2023 at 12:00 p.m. CST.
